LGBT Rights

Cuba currently has amongst the most progressive sets of rights for trans and gay people in the world.

Cuba treats trans rights as a health issue, and as such is covered under the national policies on healthcare and universal access to care.

The 2022 Cuban Family Code referendum legalized same gender marriage, strengthened gender equality laws, legalized altruistic surrogacy.

Attitudes towards LGBT individuals have become more accepting over the decades.

Citizenship Pathways

Citizenship in Cuba is based on jus soli and jus sanguinus. This will discuss jus sanguinus pathways.

If a parent was a Cuban citizen, one is also a Cuban citizen. The Cuban parent must acknowledge the child in order for the child to be eligible for Cuban citizenship.

This will require an authenticated, not an apostilled, copy of the long form birth certificate and documentation from the Cuban parent avowing the child as theirs. All documentation must be translated into Spanish.

Immigration Pathways

Unlike other potential places, the most likely path toward migration to Cuba for Americans would be seeking asylum. Such an action must not be considered lightly, as one aspect of refugee status in general is the inability to ever return to the country one seeks refuge from.

However, the Cuban government is likely to consider Americans who attempt to seek refuge in Cuba as a propaganda coup. Similar to other Communist states that were adversaries of the US, defections and defectors are often used as part of propaganda campaigns, and your status as a former American seeking refuge is likely to become public knowledge.
